Buying Dubai Property by Power of Attorney: A Practical Guide

How to buy Dubai property without being there — drafting a POA, notarisation and legalisation from abroad, what powers to grant, who to appoint, and where banks still want you in person.

Overseas buyers often assume a Dubai purchase requires flights: one trip to view, another to sign, a third to transfer. In reality, every signature-requiring step can be delegated to someone you trust through a power of attorney (POA) — if the document is prepared the way Dubai's authorities expect.

What a POA does in a Dubai property deal

A POA authorises a named person — your attorney-in-fact — to act for you in defined matters: signing the Memorandum of Understanding, representing you at the trustee office, completing the Dubai Land Department transfer, signing mortgage documentation where the bank permits it. The Dubai Land Department and registration trustees accept properly executed POAs daily; this is standard machinery, not a workaround.

Getting the document accepted: the formalities

This is where remote purchases succeed or stall.

  • Signed abroad? The POA must generally be notarised where you sign it, then legalised for use in the UAE — attestation through the relevant foreign ministry and UAE embassy in your country, with final attestation in the UAE. Allow two to four weeks for the full chain; start early.
  • Language. Documents used before UAE authorities need a legal Arabic translation by a translator recognised in the UAE. Bilingual POA drafts avoid ambiguity between versions.
  • Signed in the UAE? If you can visit once, executing the POA before a UAE notary in a single appointment is dramatically simpler — many buyers do exactly one trip, for this.
  • Validity. Real-estate POAs in Dubai have formal validity limits — commonly re-confirmed after a period — and specific transactions (particularly selling) face stricter scrutiny than buying. Check current requirements when drafting; your conveyancer or broker will know the practice of the day.

What powers to include — and exclude

The drafting principle: specific enough to complete your transaction, no broader than necessary.

Worth including for a purchase with a mortgage: reserving/purchasing the identified property (or a defined price cap), signing the MoU and transfer documents, dealing with the DLD and trustee offices, opening and operating the transaction account to the extent the bank allows, signing mortgage and insurance documents, receiving and signing the title deed, paying fees.

Worth excluding unless genuinely needed: general powers over all your assets, powers to sell or mortgage anything beyond the target property, indefinite duration. A tight POA protects both you and your attorney — nobody wants discretion they did not ask for.

Who should you appoint?

A spouse or close family member in the UAE is the common choice; a lawyer or professional conveyancer is the professional one. Two practical notes: pick someone who can physically attend appointments during working hours in Dubai, and remember the POA holder generally cannot self-deal — appointing the person selling you the property, or the agent earning commission on it, invites conflict-of-interest problems and extra scrutiny.

Where the bank fits

Mortgage lenders each have their own policy on POA signing. Many accept a POA for property-side documents while wanting the account opening and KYC done with you directly — which banks can often complete remotely, by video, or during a single short visit. Some accept POA for the full journey. This varies enough that it should shape which bank you apply to if avoiding travel matters to you — exactly the kind of lender-matching a broker does. Non-resident buyers should read this alongside our non-resident mortgage guide and the myths piece — "you must fly in to buy" is one of the more durable ones.

The remote purchase, end to end

  1. POA drafted (bilingual), signed, notarised and legalised in your country
  2. Mortgage pre-approval arranged remotely — documents move by email and courier
  3. Property secured; your attorney signs the MoU
  4. Valuation, final offer, insurance — handled in-country
  5. Your attorney attends transfer day; the title deed issues in your name

Done in this order, the buyer's physical presence is required for none of it — or for one short, well-planned trip.
